Terms of Service

Last updated: 1 March 2025

1. About SplitPay

SplitPay is a bill-splitting and payment-request platform operated by SplitPay Ltd, a company registered in England and Wales. By using SplitPay you agree to these Terms of Service ("Terms"). Payment initiation services are provided by TrueLayer Limited (FRN 901096), authorised by the FCA. Card payments are processed by Stripe Inc. SplitPay itself does not hold, move, or store any funds.

2. Eligibility

You must be at least 18 years old and a UK resident to use SplitPay. By creating an account you confirm that you meet these requirements. We reserve the right to close accounts that do not meet eligibility criteria.

3. Your account

You are responsible for all activity that occurs under your account. Keep your phone number up to date — it is your primary means of authentication. Do not share OTP codes with anyone. If you suspect unauthorised access to your account, contact us immediately at support@split-pay.co.uk.

4. Payment requests

When you create a payment request, you are requesting money from a third party for a genuine obligation. You must not use SplitPay to: • Request money for goods or services you have not provided. • Harass, coerce, or deceive any person. • Process payments on behalf of third parties (money service business activity). • Circumvent any sanctions or financial crime controls. Payment links expire as set by you (between 24 hours and 30 days). Expired links cannot be paid.

5. Fees

Free plan: a 0.5% fee (maximum £2) applies to each Open Banking payment received. Plus plan (£2.99/month): no transaction fee on Open Banking payments. Pro plan (£6.99/month): no transaction fee on Open Banking payments. Card payments (Stripe): a 1.5% + 20p fee applies regardless of plan. This reflects Stripe's processing costs. Subscription fees are charged monthly in advance. No refunds are issued for partial months.

6. Prohibited uses

You must not use SplitPay for any unlawful purpose or in any way that could harm SplitPay, other users, or third parties. Prohibited uses include but are not limited to: fraud, money laundering, funding illegal activity, or impersonating another person. Violation of these Terms may result in immediate account suspension and reporting to relevant authorities.

7. Intellectual property

All intellectual property in the SplitPay platform — including the software, design, trademarks, and content — belongs to SplitPay Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of SplitPay without our express written permission.

8. Limitation of liability

SplitPay is provided "as is". To the maximum extent permitted by law, SplitPay Ltd shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the platform. Our total liability to you for any direct loss shall not exceed the subscription fees you have paid to us in the 12 months preceding the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

9. Termination

You may close your account at any time from your profile settings. We may suspend or terminate your account at any time if we believe you have violated these Terms, are engaged in fraudulent activity, or for any other legitimate business reason. On termination, your data is handled in accordance with our Privacy Policy.

10. Governing law

These Terms are governed by English law. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have rights under the laws of the country where you reside that cannot be excluded by this clause.

11. Changes to these Terms

We may update these Terms from time to time. We will give you at least 30 days' notice of material changes via the app or by SMS. Continued use of SplitPay after the notice period constitutes acceptance.
